The Austrian player Rasid Mahalbasic and the Slovenian agent Admir Fazlic filed a claim against the Turkish club Fenerbahce Ülker BC for outstanding salaries, compensation and agent fees. The player requested full payment of his salaries for the 2010-2011, 2011-2012 and 2012-2013 seasons, submitting that he had terminated the employment contract with just cause due to the club's failure to pay his salaries after he had been temporarily assigned to other clubs. In its answer, the club argued that the Player had tacitly agreed to terminate the contract when signing employment agreements with such other clubs. The club further argued that at the time of the conclusion of the player's employment contract the agent had not been licensed by FIBA and was therefore not entitled to any agent fees. The Arbitrator decided to partially uphold the claim.
